OBJECT
The "My Kerasilk Story" shoot application is being run by Kao Germany GmbH, Pfungstädter Straße 98-100, 64297 Darmstadt, Germany, under the Kerasilk brand (hereinafter referred to as the "Organizer"). The competition takes place exclusively in the period from September 16th, 2024 (00:00 GTM) to September 23rd, 2024 (23:59 GTM) (= competition period). Participation takes place exclusively within the framework of these conditions of participation. By participating in the competition at the latest, the participant accepts these conditions of participation.

CONDITIONS OF PARTICIPATION
Eligible to participate are persons who have reached the age of 18 and are resident in Amsterdam, Netherlands and Berlin, Germany. Employees of the organizer, their relatives and all persons involved in the conception and implementation of this competition (e.g. employees of commissioned agencies) are excluded.

Participation is only permitted by the participant in person; participation via automated procedures (e.g. competition clubs or competition service providers) and participation with falsified identities or with identities of third parties is not permitted.

HOW DO I TAKE PART?
To take part in the selection, participants must comment 🤍 on the feed post to receive the application questionnaire. Fill this out in its entirety before 23:59GMT on 23rd of September 2024.. Applications filled in/send back after this date will not be considered.

PRIZES
Participation at the next My KERASILK Story shoot on the 10th & 11th February.

NOTIFICATION AND DELIVERY OF THE PRIZE
The winners will be notified via the Instagram channel "Kerasilkofficial" by direct message or e-mail.

If a winner does not respond to this message within 24 hours or if their contact details are incorrect or incomplete, the participation will be forfeited without substitution and a new search will be held to determine another participant.

LIABILITY
The organizer is not liable for technical problems during participation in the competition, in particular in the event of malfunctions of the technical systems and service, incorrect content, loss or deletion of data and viruses, as well as lost mail and any resulting damage.

Claims for damages against the organizer or one of its vicarious agents in connection with the competition are excluded, irrespective of the legal grounds, unless the organizer or its vicarious agents have acted with intent or gross negligence. In cases of slight negligence, which lead to delay or impossibility of the performance owed, as well as in the event of a breach of a material obligation and thus the breach of an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely, the organizer is liable for resulting property damage and financial losses only in the amount of the foreseeable, typically occurring damage.

The aforementioned limitations of liability shall not apply in the event of a breach of material contractual obligations or in the event of injury to life, limb or health or for liability under the Product Liability Act. 

EXCLUSION OF PARTICIPANTS
The organizer reserves the right to exclude participants who provide false or incomplete information, who use unauthorized aids, who are suspected of manipulation or who violate these conditions of participation in any other way, from participation without giving reasons.

If the conditions for exclusion are met, prizes may be subsequently disallowed or prizes already paid out or delivered may be reclaimed. 

MODIFICATION/TERMINATION OF THE COMPETITION
The organizer reserves the right to interrupt or terminate the competition in the event of unforeseen circumstances and accepts no liability for lost chances of winning.

LEGAL MATTERS
Legal recourse is excluded with regard to the drawing of the winners.

SCOPE AND PURPOSE OF PROCESSING
If you win, the following data must be collected:

- Surname, first name

We process the personal data of the participants in order to carry out the competition, in particular to send the prize. The organizer will only process the participant data for market research purposes if the participant has given their consent. The participant can revoke this consent at any time by sending a corresponding message to the address. The granting of consent has no influence whatsoever on the chances of winning.

LEGAL BASIS FOR PROCESSING
Data processing serves the sole purpose of carrying out the competition. The legal basis for the processing of personal data to fulfill this obligation is therefore Art. 6 para. 1 lit. b) of the EU General Data Protection Regulation (GDPR).

RECIPIENTS OF PERSONAL DATA
Participants' data will only be transferred to other parties - apart from an internal transfer to our IT sister company, secured by standard contractual clauses stipulated by the EU - if this is necessary for the execution of the competition (e.g. for the purpose of sending prizes) and if there is an authorization to transfer data under data protection law. All processors have been carefully selected, support the organizer strictly in accordance with instructions and only receive access to your data to the extent and for the period required to provide the services.

STORAGE PERIOD
After the end of the competition, your data processed by us as part of the competition will generally be deleted within 60 days, provided there are no statutory retention obligations.

RIGHTS OF DATA SUBJECTS
You have the right to information about the personal data concerning you and to rectification or erasure or restriction of processing and a right to object to processing as well as the right to data portability. You also have the right to complain to the competent supervisory authority about the processing of your personal data by us.
